Điều 1. Giới thiệu

1.1 Chính Sách Quyền Riêng Tư này (gọi chung là "Chính Sách") được CÔNG TY CỔ PHẦN CÔNG NGHỆ BLUE OCEAN ("Gademy", "Chúng tôi" hoặc "của Chúng tôi") ban hành nhằm giúp Bạn hiểu cách Gademy thu thập, sử dụng, lưu trữ, chia sẻ và bảo vệ Dữ Liệu Cá Nhân khi Bạn truy cập hoặc sử dụng Gademy.

1.2 Trong Chính Sách này, ứng dụng Gademy trên iOS và Android cùng các tính năng, nội dung và dịch vụ được cung cấp thông qua ứng dụng được gọi chung là "Dịch Vụ". Chính Sách áp dụng đối với Tài Khoản Global, Tài Khoản SIS do trường học cấp và các tài khoản khác được sử dụng để truy cập Dịch Vụ, nếu có.

1.3 Trong phạm vi Chính Sách này, "Bạn" được hiểu là người sử dụng Dịch Vụ, bao gồm người chơi, phụ huynh/người giám hộ và, trong phạm vi liên quan, người dùng được trường học kết nối với Gademy. "Dữ Liệu Cá Nhân" được hiểu là các thông tin liên quan đến Bạn mà Gademy thu thập và sử dụng theo Chính Sách này.

1.4 CÔNG TY CỔ PHẦN CÔNG NGHỆ BLUE OCEAN là đơn vị vận hành Gademy và là bên kiểm soát Dữ Liệu Cá Nhân trong phạm vi Chính Sách này. Thông tin liên hệ của Chúng tôi như sau:

1.5 Bằng việc sử dụng Dịch Vụ, Bạn xác nhận đã đọc và hiểu các nội dung được quy định tại Chính Sách này.

Article 1. Introduction

1.1 This Privacy Policy (the "Policy") is issued by BLUE OCEAN TECHNOLOGY JOINT STOCK COMPANY ("Gademy", "We", "Us" or "Our") to help You understand how Gademy collects, uses, stores, shares, and protects Personal Data when You access or use Gademy.

1.2 In this Policy, the Gademy application on iOS and Android, together with the features, content, and services provided through the application, is collectively referred to as the "Service". This Policy applies to Global Accounts, SIS Accounts issued by schools, and any other Accounts used to access the Service, if applicable.

1.3 For the purposes of this Policy, "You" means a user of the Service, including Players, Parents/Legal Guardians, and, where relevant, users connected to Gademy through a school. "Personal Data" means information relating to You that Gademy collects and uses in accordance with this Policy.

1.4 BLUE OCEAN TECHNOLOGY JOINT STOCK COMPANY operates Gademy and acts as the Personal Data Controller for the purposes of this Policy. Our contact details are as follows:

• (a) International name: BLUE OCEAN TECHNOLOGY JOINT STOCK COMPANY; abbreviated name: BLUE OCEAN TECH.

• (f) Expected initial response time: within 2 business days. If a request is complex and requires additional time, Gademy will notify You as necessary.

1.5 By using the Service, You acknowledge that You have read and understood this Policy.

Điều 2. Gademy thu thập những Dữ Liệu Cá Nhân nào?

2.1 Tùy thuộc vào loại tài khoản và các tính năng Bạn sử dụng, Gademy có thể thu thập và sử dụng các nhóm Dữ Liệu Cá Nhân sau đây:

• (a) Thông tin hồ sơ người chơi: họ và tên, ngày sinh, khối lớp, tên đăng nhập (username) và thông tin hồ sơ hoặc tùy chỉnh nhân vật.
• (b) Thông tin liên hệ và xác minh: số điện thoại của người dùng từ 16 tuổi trở lên hoặc số điện thoại của phụ huynh/người giám hộ; mã OTP và trạng thái xác minh.
• (c) Thông tin phụ huynh/người giám hộ: thông tin được cung cấp trong quá trình đăng ký; các xác nhận về tư cách giám hộ, sự đồng ý, trách nhiệm giám sát và quản lý tài khoản của người dùng dưới 16 tuổi; trạng thái Guardian PIN.
• (d) Thông tin tài khoản và bảo mật: tên đăng nhập, mật khẩu ở dạng được hệ thống lưu trữ an toàn, lịch sử đăng nhập, trạng thái tài khoản, yêu cầu đặt lại PIN/mật khẩu và các sự kiện bảo mật có liên quan.
• (e) Dữ liệu trường học/SIS: username SIS, thông tin định danh và trạng thái học sinh do trường học cung cấp, thông tin liên kết với trường, trạng thái Active/Inactive
• (f) Dữ liệu học tập và sử dụng trò chơi: tiến trình học/chơi, bài học và nhiệm vụ đã hoàn thành, chuỗi đăng nhập, phần thưởng, Gems, Stars, vật phẩm, kho đồ, tùy chỉnh, giới hạn thời gian chơi và thông tin về việc tương tác với các tính năng của Dịch Vụ.
• (g) Nội dung do người dùng tạo và dữ liệu kiểm duyệt: nickname, báo cáo người chơi, cảnh báo, Nội dung bị hệ thống che hoặc chặn vẫn có thể được lưu trong phạm vi cần thiết để kiểm duyệt và tuân thủ quy định pháp luật.
• (h) Dữ liệu liên quan đến yêu cầu hỗ trợ và xóa tài khoản: nội dung yêu cầu, thông tin xác minh, trạng thái giải quyết, ngày dự kiến hoàn tất, việc hủy yêu cầu và các nhật ký cần thiết để chứng minh việc tuân thủ.
• (i) Dữ liệu sử dụng ứng dụng và dữ liệu kỹ thuật phát sinh khi Bạn đăng nhập, sử dụng hoặc tương tác với các tính năng của Dịch Vụ, trong phạm vi cần thiết để đo lường việc sử dụng, bảo mật và cải thiện sản phẩm.

2.2 Gademy không sử dụng mạng quảng cáo và không chủ động thu thập mã định danh quảng cáo (advertising ID), dữ liệu vị trí chính xác, ảnh, dữ liệu từ micrô hoặc camera.

Article 2. What personal data does Gademy collect?

2.1 Depending on the type of Account and the features You use, Gademy may collect and use the following categories of Personal Data:

• (a) Player profile information: full name, date of birth, grade level, username, and profile or character customization information.
• (b) Contact and verification information: the phone number of a user aged 16 or older or the phone number of a Parent/Legal Guardian; OTP codes; and verification status.
• (c) Parent/Legal Guardian information: information provided during registration; confirmations regarding guardian status, consent, supervision responsibilities, and management of the Account of a user under 16 years of age; and Guardian PIN status.
• (d) Account and security information: username, password information stored securely by the system, login history, Account status, PIN/password reset requests, and related security events.
• (e) School/SIS data: SIS Username, student identification information and status provided by the school, information linking the student to the school, and Active/Inactive status.
• (f) Learning and gameplay data: learning/gameplay progress, completed lessons and missions, login streaks, rewards, Gems, Stars, items, inventory, customizations, play-time limits, and information about interactions with features of the Service.
• (g) User-generated content and moderation data: nicknames, Player reports, and warnings. Content masked or blocked by the system may still be retained to the extent necessary for moderation and compliance with applicable law.
• (h) Support and Account deletion request data: the content of requests, verification information, resolution status, expected completion date, request cancellation information, and logs necessary to demonstrate compliance.
• (i) Application usage data and technical data generated when You log in to, use, or interact with features of the Service, to the extent necessary to measure usage, maintain security, and improve the product.

2.2 Gademy does not use advertising networks and does not actively collect advertising identifiers (advertising IDs), precise location data, photos, microphone data, or camera data.

Điều 3. Gademy thu thập Dữ Liệu Cá Nhân từ đâu?

3.1 Gademy có thể thu thập Dữ Liệu Cá Nhân của Bạn từ các nguồn sau đây:

• (a) Trực tiếp từ Bạn hoặc phụ huynh/người giám hộ khi đăng ký, xác minh tài khoản, sử dụng tính năng, gửi báo cáo hoặc liên hệ hỗ trợ.
• (b) Tự động phát sinh trong quá trình Bạn học, chơi, đăng nhập hoặc tương tác với hệ thống.
• (c) Từ trường học và hệ thống SIS đối với tài khoản do trường học cấp hoặc quản lý.
• (d) Thông qua các công cụ phân tích và SDK kỹ thuật khi Bạn tương tác với ứng dụng.
• (e) Từ các nhà cung cấp kỹ thuật được Gademy sử dụng để cung cấp, bảo mật và vận hành Dịch Vụ.

Article 3. Sources of personal data

3.1 Gademy may collect Your Personal Data from the following sources:

• (a) Directly from You or a Parent/Legal Guardian when You register, verify an Account, use features, submit reports, or contact support.
• (b) Automatically from data generated when You learn, play, log in, or interact with the system.
• (c) From schools and SIS systems in connection with Accounts issued or managed by schools.
• (d) Through analytics tools and technical SDKs when You interact with the application.
• (e) From technical service providers engaged by Gademy to provide, secure, and operate the Service.

Điều 4. Gademy sử dụng Dữ Liệu Cá Nhân như thế nào?

4.1 Gademy có thể sử dụng Dữ Liệu Cá Nhân của Bạn cho một hoặc nhiều mục đích sau đây:

• (a) Tạo, xác minh, duy trì và bảo vệ Tài Khoản; xác thực OTP và hỗ trợ đăng nhập.
• (b) Cung cấp trải nghiệm học tập và trò chơi; lưu tiến trình, phần thưởng, vật phẩm, giao dịch
• (c) Xác nhận giao dịch mua sản phẩm ảo trong ứng dụng và quyền lợi trong ứng dụng dựa trên thông tin giao dịch do nền tảng cửa hàng ứng dụng cung cấp.
• (d) Cung cấp hỗ trợ, điều tra sự cố, phòng chống gian lận hoặc lạm dụng, bảo đảm an toàn của hệ thống và tuân thủ các yêu cầu của pháp luật.
• (e) Đo lường việc sử dụng ứng dụng, đánh giá mức độ sử dụng các tính năng và hỗ trợ cải thiện sản phẩm.

Article 4. How does Gademy use personal data?

4.1 Gademy may use Your Personal Data for one or more of the following purposes:

• (a) To create, verify, maintain, and protect Accounts; perform OTP authentication; and support login.
• (b) To provide the learning and gameplay experience and record progress, rewards, items, and transactions.
• (c) To confirm purchases of virtual products in the application and related in-app entitlements based on transaction information provided by the relevant app store platform.
• (d) To provide support, investigate incidents, prevent fraud or abuse, maintain system security, and comply with legal requirements.
• (e) To measure application usage, assess feature usage, and improve the product.

Điều 5. Căn cứ thu thập, sử dụng dữ liệu và sự đồng ý

5.1 Gademy thu thập và sử dụng Dữ Liệu Cá Nhân trong phạm vi cần thiết để cung cấp Dịch Vụ theo Điều Khoản Dịch Vụ, thực hiện nghĩa vụ pháp lý, bảo vệ Bạn và hệ thống, hoặc dựa trên sự đồng ý hợp lệ khi pháp luật yêu cầu. Các yêu cầu về sự đồng ý và quyền rút lại sự đồng ý được áp dụng theo Luật Bảo vệ dữ liệu cá nhân số 91/2025/QH15;

5.2 Gademy ghi nhận bằng chứng về sự đồng ý dưới dạng điện tử gắn với Tài Khoản, bao gồm phiên bản Chính Sách được chấp nhận, nội dung hoặc mục đích đã đồng ý, thời điểm xác nhận, nhóm tuổi của Tài Khoản và trạng thái xác thực OTP.

Article 5. Legal bases for data collection and use; consent

5.1 Gademy collects and uses Personal Data to the extent necessary to provide the Service under the Terms of Service, comply with legal obligations, protect You and the system, or on the basis of valid consent where required by law. Requirements relating to consent and the withdrawal of consent are governed by the Law on Personal Data Protection No. 91/2025/QH15.

5.2 Gademy records evidence of consent electronically and associates it with the Account, including the version of the Policy accepted, the scope or purposes for which consent was given, the time of confirmation, the Account age group, and OTP verification status.

Điều 6. Người dùng dưới 16 tuổi và quyền kiểm soát của phụ huynh

6.1 Người dùng dưới 16 tuổi chỉ được tạo và sử dụng Tài Khoản sau khi phụ huynh/người giám hộ xác minh số điện thoại bằng OTP và xác nhận tư cách đại diện, trách nhiệm giám sát, tính chính xác của thông tin, Điều Khoản Dịch Vụ và Chính Sách này.

Article 6. Users under 16 and parental controls

6.1 A user under 16 years of age may create and use an Account only after the Parent/Legal Guardian verifies their phone number using an OTP, confirms their status as the lawful representative, acknowledges their responsibility for supervision, confirms the accuracy of the information provided, and agrees to the Terms of Service and this Policy.

Điều 7. Gademy chia sẻ Dữ Liệu Cá Nhân với ai?

7.1 Gademy chỉ chia sẻ Dữ Liệu Cá Nhân trong phạm vi cần thiết cho các mục đích được quy định tại Chính Sách này. Các bên có thể nhận dữ liệu bao gồm:

• (a) Trường học và hệ thống SIS: để xác thực tài khoản trường, đồng bộ trạng thái học sinh và hỗ trợ quản trị Tài Khoản SIS.
• (b) Nhà cung cấp OTP/SMS: để gửi mã xác thực và các thông báo liên quan đến Tài Khoản.
• (c) Nhà cung cấp công cụ phân tích và SDK kỹ thuật: để đo lường việc sử dụng, theo dõi hiệu năng, bảo mật và cải thiện Dịch Vụ.
• (d) Nhà cung cấp hosting/cloud và các dịch vụ kỹ thuật khác: để lưu trữ, bảo mật và vận hành Dịch Vụ trong phạm vi cần thiết.
• (e) Cơ quan nhà nước, tòa án hoặc chủ thể có thẩm quyền: khi Gademy có nghĩa vụ pháp lý hoặc khi cần bảo vệ quyền, sự an toàn và tính toàn vẹn của Dịch Vụ.

7.2 Gademy không bán Dữ Liệu Cá Nhân của Bạn.

Article 7. With whom does Gademy share personal data?

7.1 Gademy shares Personal Data only to the extent necessary for the purposes set out in this Policy. Recipients of Personal Data may include:

• (a) Schools and SIS systems: to authenticate school Accounts, synchronize student status, and support the administration of SIS Accounts.
• (b) OTP/SMS providers: to send verification codes and Account-related notifications.
• (c) Analytics and technical SDK providers: to measure usage, monitor performance, maintain security, and improve the Service.
• (d) Hosting/cloud providers and other technical service providers: to store, secure, and operate the Service to the extent necessary.
• (e) Government authorities, courts, or other competent authorities: where Gademy is subject to a legal obligation to disclose data or where disclosure is necessary to protect rights, ensure safety, or preserve the integrity of the Service.

7.2 Gademy does not sell Your Personal Data.

Điều 8. Dịch vụ và nội dung của bên thứ ba

8.1 Gademy có thể sử dụng các nhà cung cấp dịch vụ kỹ thuật, bao gồm dịch vụ OTP/SMS, công cụ phân tích, SDK, hosting/cloud và các dịch vụ cần thiết khác để cung cấp, bảo mật và cải thiện Dịch Vụ.

8.2 Các nhà cung cấp này chỉ được sử dụng Dữ Liệu Cá Nhân trong phạm vi cần thiết để cung cấp dịch vụ cho Gademy, theo thỏa thuận với Gademy và phù hợp với pháp luật áp dụng.

Article 8. Third-party services and content

8.1 Gademy may use technical service providers, including providers of OTP/SMS services, analytics tools, SDKs, hosting/cloud services, and other services necessary to provide, secure, and improve the Service.

8.2 These providers may use Personal Data only to the extent necessary to provide services to Gademy, in accordance with their agreements with Gademy and applicable law.

Điều 9. Chuyển dữ liệu và nơi lưu trữ

9.1 Gademy không thực hiện việc chuyển Dữ Liệu Cá Nhân của Bạn ra ngoài Việt Nam.

Article 9. Data transfers and location of storage

9.1 Gademy does not transfer Your Personal Data outside Vietnam.

Điều 10. Thời hạn lưu trữ

10.1 Gademy lưu giữ thông tin người chơi trong suốt quá trình người chơi sử dụng Dịch Vụ và trong 06 tháng sau khi người chơi ngừng sử dụng Dịch Vụ.

10.2 Tùy theo loại dữ liệu và mục đích sử dụng, thời hạn lưu trữ được áp dụng như sau:

• (a) Thông tin Tài Khoản và hồ sơ người chơi: được lưu trong suốt thời gian sử dụng Dịch Vụ và 06 tháng sau khi người chơi ngừng sử dụng Dịch Vụ.
• (b) Dữ liệu học tập/gameplay gắn với hồ sơ người chơi, bao gồm tiến trình, phần thưởng, Stars, Gems và vật phẩm: áp dụng cùng thời hạn nêu trên trong phạm vi các dữ liệu này là một phần của thông tin người chơi cần thiết để duy trì Tài Khoản và quyền lợi. Trường hợp dữ liệu giao dịch phải được lưu lâu hơn theo quy định về kế toán, thuế hoặc bảo vệ người tiêu dùng, nếu có, Gademy sẽ áp dụng thời hạn theo quy định pháp luật chuyên ngành tương ứng.
• (c) Hồ sơ hỗ trợ và nhật ký kỹ thuật/bảo mật: chỉ được lưu trong thời gian cần thiết để giải quyết yêu cầu, điều tra sự cố, phòng chống gian lận và bảo đảm an toàn hệ thống.

10.3 Khi Dữ Liệu Cá Nhân không còn cần thiết cho các mục đích nêu trên, Gademy sẽ xóa hoặc khử nhận dạng dữ liệu, trừ trường hợp Gademy phải tiếp tục lưu giữ để tuân thủ nghĩa vụ pháp lý, thực hiện hợp đồng, giải quyết tranh chấp, bảo vệ quyền và lợi ích hợp pháp hoặc đáp ứng yêu cầu hợp pháp của cơ quan có thẩm quyền.

10.4 Gademy xác định thời gian lưu trữ dựa trên yêu cầu của pháp luật áp dụng; tính chất, số lượng và mức độ nhạy cảm của dữ liệu; rủi ro do truy cập hoặc tiết lộ trái phép; mục đích sử dụng dữ liệu; và khả năng đạt được mục đích đó bằng biện pháp khác.

Article 10. Retention period

10.1 Gademy retains Player information throughout the period in which the Player uses the Service and for 6 months after the Player stops using the Service.

10.2 Depending on the type of data and the purpose of use, the following retention periods apply:

• (a) Account information and Player profile information: retained throughout the period in which the Player uses the Service and for 6 months after the Player stops using the Service.
• (b) Learning/gameplay data associated with the Player profile, including progress, rewards, Stars, Gems, and items: subject to the same retention period described above to the extent that such data forms part of the Player information necessary to maintain the Account and related entitlements. Where applicable accounting, tax, or consumer protection laws require transaction data to be retained for a longer period, Gademy will apply the retention period prescribed by the relevant sector-specific law.
• (c) Support records and technical/security logs: retained only for as long as necessary to handle requests, investigate incidents, prevent fraud, and maintain system security.

10.3 When Personal Data is no longer necessary for the purposes described above, Gademy will delete or de-identify the data, unless continued retention is necessary to comply with legal obligations, fulfill contractual obligations, resolve disputes, protect lawful rights and interests, or respond to a lawful request from a competent authority.

10.4 Gademy determines retention periods based on applicable legal requirements; the nature, volume, and sensitivity of the data; the risks arising from unauthorized access or disclosure; the purposes for which the data is used; and whether those purposes can be achieved by other means.

Điều 11. Bảo mật dữ liệu và tài khoản

11.1 Gademy áp dụng các biện pháp tổ chức và kỹ thuật phù hợp để bảo vệ Dữ Liệu Cá Nhân và hạn chế truy cập trái phép.

11.2 Bạn có trách nhiệm giữ bí mật mật khẩu, OTP, đồng thời thông báo ngay cho Gademy qua kênh hỗ trợ chính thức nếu nhận thấy hoặc nghi ngờ Tài Khoản bị truy cập trái phép.

11.3 Gademy không yêu cầu Bạn cung cấp mật khẩu, OTP, hoặc thông tin thanh toán qua tin nhắn, mạng xã hội, email hoặc điện thoại ngoài các luồng xác thực chính thức trong ứng dụng.

11.4 Face ID, vân tay hoặc PIN của thiết bị, nếu được sử dụng để lưu hoặc điền thông tin đăng nhập, do hệ điều hành của thiết bị quản lý. Gademy không thu thập, lưu trữ hoặc sử dụng dữ liệu sinh trắc học này.

Article 11. Data and account security

11.1 Gademy implements appropriate organizational and technical measures to protect Personal Data and limit unauthorized access.

11.2 You are responsible for keeping Your password and OTP codes confidential and must promptly notify Gademy through the official support channel if You become aware of or suspect unauthorized access to Your Account.

11.3 Gademy will not ask You to provide Your password, OTP code, or payment information through messages, social media, email, or telephone outside the official in-app authentication flows.

11.4 If Face ID, a fingerprint, or the device PIN is used to save or autofill login credentials, that functionality is managed by the device operating system. Gademy does not collect, store, or use biometric data for this purpose.

Điều 12. Quyền và lựa chọn của Bạn

12.1 Tùy thuộc vào quy định pháp luật áp dụng và kết quả xác minh danh tính, Bạn hoặc phụ huynh/người giám hộ có thể yêu cầu:

• (a) được biết về việc Gademy thu thập và sử dụng Dữ Liệu Cá Nhân;
• (b) truy cập Dữ Liệu Cá Nhân;
• (c) sửa thông tin không chính xác;
• (d) rút lại sự đồng ý;
• (e) hạn chế hoặc phản đối việc sử dụng dữ liệu trong trường hợp pháp luật cho phép; hoặc
• (f) xóa Dữ Liệu Cá Nhân hoặc Tài Khoản.

12.2 Gademy có thể cần tiếp tục lưu giữ một phần dữ liệu khi pháp luật yêu cầu hoặc khi cần thiết để thiết lập, thực hiện hoặc bảo vệ quyền và lợi ích hợp pháp.

12.3 Gademy dự kiến phản hồi ban đầu trong vòng 02 ngày làm việc. Đối với yêu cầu phức tạp cần thêm thời gian, Gademy sẽ thông báo cho Bạn khi cần thiết.

Article 12. Your rights and choices

12.1 Subject to applicable law and successful identity verification, You or a Parent/Legal Guardian may request any of the following:

• (a) information about Gademy's collection and use of Personal Data;
• (b) access to Personal Data;
• (c) correction of inaccurate information;
• (d) withdrawal of consent;
• (e) restriction of, or objection to, the use of data where permitted by law; or
• (f) deletion of Personal Data or the Account.

12.2 Gademy may need to continue retaining certain data where required by law or where necessary to establish, exercise, or protect lawful rights and interests.

12.3 Gademy expects to provide an initial response within 2 business days. If a request is complex and requires additional time, Gademy will notify You as necessary.

Điều 13. Công cụ phân tích, SDK và quyền trên thiết bị

13.1 Gademy có thể sử dụng các công cụ phân tích và SDK kỹ thuật để đo lường việc sử dụng, theo dõi hiệu năng, bảo mật và cải thiện Dịch Vụ.

13.2 Gademy không sử dụng đối tác quảng cáo và không yêu cầu quyền truy cập dữ liệu vị trí chính xác, ảnh, micrô hoặc camera cho mục đích phân tích.

Article 13. Analytics tools, SDKs, and device permissions

13.1 Gademy may use analytics tools and technical SDKs to measure usage, monitor performance, maintain security, and improve the Service.

13.2 Gademy does not engage advertising partners and does not request access to precise location data, photos, the microphone, or the camera for analytics purposes.

15.1 Gademy may update this Policy from time to time to reflect changes to the Service, legal requirements, or the manner in which Gademy collects and uses Personal Data.

15.2 If material changes are made, Gademy will provide reasonable notice in the application or through another official channel and, where required by law, will obtain renewed consent before collecting or using Personal Data for any new purpose.
